Learn about the right of publicity in NY and the new post-mortem right of publicity law!
New York has joined over 20 states that allow an individual’s rights to the commercial use of their name or likeness to survive after their death. This class offers an overview of New York’s new post-mortem right of publicity law, effective May 2021. This law, and the right of publicity overall, impacts a wide variety of artistic disciplines including photography, film and media, literature, visual arts, and more. In addition to understanding the new law, artists and attorneys will come away with a better understanding of what is a commercial use and when does the First Amendment permit the unauthorized use of a person’s name or likeness.
