Ethics for Patent Practitioners: From Application to Appeal (CLE)

Learn about the ethics issues associated with patent practice! Attorneys will receive 1.5 Ethics CLE Credits.

This class will discuss major ethics issues associated with patent practice, beginning with the ethical responsibilities attendant to filing and prosecuting patent applications. The course will include an in depth discussion of the disciplinary process at the U.S. Patent and Trademark Office, and its intersection with state disciplinary practice. Litigation ethics will be explored from the initiation of a lawsuit through appeal, with emphasis on common ethical pitfalls encountered in patent litigation. Real ethics cases and investigations will be referenced throughout the class in order to put the lessons in context and demonstrate how conduct in the face of an accusation of impropriety can influence outcome.

Continuing Legal Education: This program offers 1.5 NY Ethics CLE Credit (Approved for Non-Transitional and Transitional Attorneys).

Christopher B. McKinley

Christopher B. McKinley, Associate, Intellectual Property Litigation at Skadden, Arps, Slate, Meagher & Flom LLP.

Christopher B. McKinley focuses his practice on all aspects of patent law, including litigating high-value patent disputes. Mr. McKinley litigates cases in U.S. district courts and before the Patent Trial and Appeal Board (PTAB), U.S. Patent and Trademark Office (USPTO) and abroad, and assists clients in corporate M&A and in acquiring patent portfolios.

Through his years of work in law and technology, Mr. McKinley has extensive experience in various technical fields, including medical devices, bicycle drivetrain and suspension systems, refrigeration systems, industrial shipping systems, trading and metadata cleaning software, and electric vehicle charging systems.

His pro bono efforts include representing disabled veterans on appeal before the U.S. Court of Appeals for Veterans Claims, low-income tenants in unlawful detainer suits in San Mateo County, California, victims of domestic abuse in restraining order proceedings in California state court and low-income inventors seeking patent protection before the USPTO.

 

Doug Nemec

Douglas R. Nemec, Partner, Intellectual Property Litigation at Skadden, Arps, Slate, Meagher & Flom LLP.

Douglas R. Nemec concentrates his practice on litigating complex cases involving intellectual property and technology. In the di-verse range of matters Mr. Nemec has led in state and federal courts from coast to coast, he has obtained positive results for clients in matters ranging from patent infringement to trade secrets to high-stakes licensing disputes.

As a registered patent attorney, he also represents clients in matters before the U.S. Patent and Trademark Office, which has become an important complement to the firm’s IP litigation practice. Additionally, in life sciences matters, Mr. Nemec has advised on defense of patent infringement claims, enforcement of patent and other IP rights, and inter partes reviews related to the treatment of a variety of ailments and diseases.

Mr. Nemec is part of the Skadden IP Litigation Group that was named a Powerhouse in BTI Litigation Outlook 2018; a leading firm in the trademark field by World Trademark Review in 2018; ranked as a nationwide Tier 1 firm for intellectual property litigation by U.S. News — Best Lawyers Best Law Firms; and named to The National Law Journal’s Intellectual Property Hot List for multiple years.
